Fansly lets verified adult creators post content of consenting adults that they own or have the rights to use, as long as they hold age, identity and consent records for everyone who appears. On top of that baseline, its Terms of Service list prohibited uses, from hate speech, impersonation and photorealistic AI to alcohol in adult content, and the same rules apply to uploads, messages and live streams. A breach can lead to removal, suspension or termination, and Fansly reserves the right to forfeit the earnings involved.

Where Fansly writes its rules down
The binding document is the Fansly Terms of Service, which carried a last-update and effective date of July 21, 2026 when this guide was checked. Its Acceptable Use section holds three lists that matter to creators: Prohibited Uses for everyone, the consequences under Violations of Prohibited Uses, and a separate set of Additional Prohibited Uses for Creators. The Your Content and Co-Authored Content clauses cover ownership and the records you must keep.
Several shorter documents sit around it: the streaming content guidelines, the Complaints policy, the DMCA notice and takedown policy and help articles such as the one on AI-generated content. When a help article and the terms describe something differently, the terms are the contract. The co-authored content clause, for instance, still describes tagging each creator who appears, while the help centre has moved collaborations to Co-Performers requests. Following the stricter of the two readings keeps you inside both.

The terms also define harmful content with an unusual yardstick: the views of the majority of creators and users within the Fansly community rather than a bystander in the street, while noting that some content users find objectionable is acceptable if it is legal where the creator is. That leaves room for judgement, and the same list prohibits anything Fansly considers inappropriate in its sole discretion, so a borderline post can be treated as a breach even if no specific rule names it.
Live streams: same rules, plus rights and timing
According to the streaming content guidelines, you can stream anything you are normally allowed to post, and the same restrictions apply. Three additions matter. You need rights or explicit permission for background music, video game footage and any other third-party material. If you stream games, review each publisher's terms, because some publishers restrict streaming behind paywalls or in adult contexts and breaking them can carry penalties or account risk. And Fansly Live is for real-time sessions only: streaming pre-recorded or previously uploaded video is not allowed even with a disclosure, so upload that material to your page instead.
The terms back the last point from the creator side, listing any attempt to pass recorded content off as a live stream as a creator-specific prohibited use. In practice, the safest stream has no copyrighted music playing in the room, a game whose publisher policy you have actually read, and nothing pre-recorded routed through your broadcasting software.
Obligations that reach beyond your own posts
Some creator rules are about conduct rather than content. The Terms of Service say creators must act in the best interests of the company at all times, whether on Fansly, on third-party websites or offline, and must not disparage or make misleading statements about it. They also oblige creators to report all violative content and suspicious activity they know about, and warn that Fansly may treat a creator who knew and stayed silent as complicit.
Money has its own limits. You certify that you will not use unauthorised third-party payment processors to accept payment for subscriptions or other services through Fansly, and the Creator Security FAQ answers the question of off-platform payment plainly: if the content or service breaks the terms, fans may not pay you for it elsewhere. Finally, the warranties in Your Content require written releases from everyone depicted, which you must hand over on request, so keep copies even after Fansly has approved a collaborator.
How enforcement, complaints and appeals work
The Complaints policy says Fansly responds to complaints within five business days and escalates those involving nonconsensual intimate depictions for resolution within 48 hours, and that it may temporarily suspend a reported user's access to some or all features while it investigates. Possible outcomes listed there include suspension, removal, demonetising or deamplifying content, withholding or forfeiting associated funds, termination, reporting to law enforcement and legal action. Fansly reserves the right not to act on activity that happens on other platforms or offline.
The same policy sets a consent standard worth memorising: consent to creating intimate content is never enough to prove consent to publishing it. Everyone depicted, identifiable or not, must consent to the creation, to publication on Fansly and, if applicable, to downloading, and Fansly can ask for written proof at any time. Anyone depicted can appeal a decision about consent, disputes Fansly cannot resolve internally go to a neutral arbitration association at its expense, and appeals against abuse takedowns go to the compliance address named in the policy with a written explanation. Repeated violations, or a single egregious one, can lead to account deletion and a permanent ban.
Copyright is handled separately. The complaint form says it is not for copyright issues; infringement claims go to Fansly's designated agent under the DMCA policy, which asks for a signature, a description of the work, the location of the copies, your contact details and statements made in good faith and under penalty of perjury. Pre-publish compliance checklist
Run through this before each upload, message drop or stream. Each item maps to a rule in the table above.
- Everyone who appears, including anyone only heard or partly visible, has an approved co-performer record.
- You hold your own copy of each person's ID and signed release, separate from what Fansly stores.
- No music, artwork, logos or footage appears that you lack permission to use.
- Nothing in shot reveals another person's details, such as names on post, screens or number plates.
- The caption, preview and price describe what the buyer will actually receive.
- There is no alcohol anywhere in adult content, background included.
- The location is private, out of public view, and yours or used with the owner's permission.
- Any AI-assisted element is clearly non-photorealistic and is not presented as real human performance.
- Links in the caption point only to sites that comply with Fansly's terms.
- For streams: the session is live, and the game publisher allows paid or adult-context streaming.
- Your avatar and banner stay free of graphic nudity after any update.
- If you live in North Carolina, you complete the state consent form Fansly shows in the upload flow.
The last item comes from Fansly's North Carolina consent article, which also says creators resident in that state cannot upload content featuring co-performers at all.
